These Terms & Conditions apply to the sale, purchase, and delivery of shipping containers (“Equipment”) sold by USA Container Hub (“Seller,” “we,” “us”). By placing an order, making payment, or accepting delivery, the Buyer (“you,” “Customer,” “Purchaser”) agrees to these Terms & Conditions and the related invoice.
Container Grades & Warranty Coverage
Important: Any modifications or alterations to the container (cutting, welding, drilling, adding doors/windows/vents, electrical, insulation, etc.) immediately void all warranties and guarantees.
1-Trip
IICL (Cargo Worthy Premium)

Buyer understands and agrees that all grades except 1-Trip may include:
Even 1-Trip containers may show minor cosmetic marks (e.g., forklift tire marks on flooring, light dents/scratches from loading/unloading).
Cosmetic Items Not Covered
Cosmetic conditions (scratches, dents, rust, previous repairs) do not affect the functional grade and are not covered by warranty, except where a 1-Trip/New container is not consistent with 1-Trip expectations.
Resolution Options (If Not On Grade / Warranty Issue)
If a container does not meet the purchased grade requirements at delivery or a covered warranty issue occurs, USA Container Hub will resolve the issue at no cost to the Buyer. Common resolutions include:

2) Warranty Disclaimer & Limitation of Liability
Except for the written guarantees listed in Section 1, USA Container Hub disclaims all other warranties, express or implied, including without limitation:
Buyer acknowledges USA Container Hub is not liable for claims, loss, or damages arising directly or indirectly from the Equipment, including but not limited to incidental, special, consequential, punitive, or exemplary damages, or lost profits, even if USA Container Hub has been advised of the possibility of such damages.
3) Delivery Terms
a) Delivery Provider & Liability
Delivery is outsourced to DOT-approved, insured trucking companies. Buyer acknowledges delivery is facilitated as a convenience and agrees to waive USA Container Hub from all liability related to delivery services.
b) Delivery Site Access & Stuck Trucks
Buyer may request a placement location; however, Buyer is responsible for ensuring safe access.
If a delivery truck gets stuck, Buyer is fully responsible for recovery/tow costs. If the requested area is inaccessible, Buyer agrees to provide an alternative safe location on the property.
c) Transit Damage / Loss
USA Container Hub is not liable for loss, theft, or damage during transit. Buyer must file claims through the delivering carrier per U.S. DOT guidelines. USA Container Hub can provide insurance documentation and reasonable assistance upon request.
d) Delivery Timeline
Estimated delivery timelines are averages only and are not guaranteed. Delivery may occur before or after the estimate. Buyer will typically be contacted to schedule delivery with approximately one-day notice. Expedited delivery may be available only if approved before purchase.
e) Delays Beyond Control
USA Container Hub will use reasonable best efforts to meet delivery timelines; however, delays due to carriers, depots, weather, mechanical issues, scheduling, or other factors beyond USA Container Hub’s control are not considered a breach.
4) Cancellation Policy
If Buyer cancels an order more than 48 hours after purchase, Buyer will be charged a $500 cancellation fee, unless USA Container Hub is in breach of these Terms.
If USA Container Hub’s performance is prevented or hindered by events outside of its control, USA Container Hub may cancel the affected portion of the invoice and issue a refund where applicable.
5) Remedies / Waiver
USA Container Hub’s remedies are cumulative and in addition to remedies available by law. Failure to enforce any term is not a waiver of future enforcement.
6) Assignment
Buyer may not assign this Agreement or any rights/obligations without USA Container Hub’s prior written consent.
7) Jurisdiction & Governing Law
Any claim arising out of or relating to this sale may be litigated in the state or federal courts located in Salt Lake County, Utah. The laws of Utah govern this Agreement.
8) Entire Agreement
These Terms & Conditions and the applicable invoice represent the entire agreement. Changes must be in writing and signed by both parties.
9) Indemnification
Buyer agrees to defend, indemnify, and hold harmless USA Container Hub, its employees and agents, from any claims, damages, losses, liabilities, costs, or attorney fees arising from Buyer’s purchase, use, operation, or disposition of the container.
10) Customer Pickup & Storage Fees
If Buyer is picking up the container, it must be picked up within 10 days of release confirmation. After 10 days, USA Container Hub will:
Ownership transfers to Buyer on the pickup date. Overdue payments may incur a service charge equal to the lesser of 2% per month or the maximum rate allowed by law, plus reasonable collection costs and attorney fees.
11) Taxes
Buyer is responsible for all taxes, fees, and government charges related to the purchase, transfer, or use of the container, including sales/use tax, VAT (if applicable), registration/title fees, duties, and related penalties/interest.
